WAIVER OF APPEAL FORM


The Waiver of Right to Appeal Form should be completed if the Defendant does not want to appeal his/her case.  It informs the Defendant that by waiving their right to appeal, the judgement against them will become final; thus, not being able to obtain any relief from the judgment in the future.

By signing this form, the Defendant certifies that they understand (1) the meaning of the effect of the judgment, (2) the right to a transcript of the proceedings in the trial court without cost to the Defendant for use in the appellate courts, (3) their right to the effective assistance of counsel to prepare and present their appeal in the appellate courts, (4) the right to have counsel without cost and (5) right to appeal from the judgment as a matter of right.
Further, the Defendant asserts that the waiver of the right to appeal is the direct result of their own free will and intellect and is completely voluntary; and no pressure, threats or promises of gain or favor have been made to induce them into waiving their right to appeal.
